At GIVBAK.com, we know that online privacy is important to our customers and you have a right to know how information we collect through this website and/or in the course of our campaigns and related contests and sweepstakes will and will not be used. We have created this privacy statement to demonstrate our firm commitment to privacy by helping you understand what kind of information we collect through our web site (the "Site") as well as how we collect and use your information.

This policy contains important information that impacts our use of your personal data. Please read this policy carefully. Use of this Site is absolutely conditioned upon reviewing, understanding and agreeing to all of the information, disclosures and disclaimers contained in (1) this Privacy Statement; and (2) the Terms and Conditions of Use governing the other terms of use of this Site.

From time to time, we may modify our privacy policy practices. In such an event, we will update this Privacy Policy, and post such revised Privacy Policy to our web site. You can find out when this Privacy Policy was last revised by referring to the revision (“Rev”) date legend under the title of this policy. Your Privacy

We do not collect or use Personal Information (as described below) about you on this web site except as discussed in this Privacy Statement.

We do not sell, share, or intentionally make available to third parties or the general public your Personal Information, except (a) as expressly disclosed below and/or (b) disclosures to our third party vendros and suppliers as may be necessary for them to perform services related to this web site on our behalf. We will use commercially reasonable means to bind such vendors to the terms and conditions of this Privacy Policy including having then commit to following this Privacy Policy by contract.

By using the procedures outlined below, you will have the opportunity to correct or change any of the Personal Information you provide to us, including changing your preferences as to whether or not you would like us to use your Personal Information to provide information on products or services that may be of interest to you.

As used in this Privacy Policy, “Personal Information” includes one or more of the following types of information: name, email address, account numbers, address, donations made, participation in campaigns, mobile phone numbers, phone numbers, and similar unique, personal information that could identify you.

Disclosures/Use of Information

Account Information. If you choose to register with the Site, you will be asked to provide information that personally identifies you and/or permits us to contact you. When you register with our Site for a user name and password, we require you to provide to us certain Personal Information including your name and e-mail address. We use such Personal Information to verify your identification, to provide you with the account information you request, and to send you correspondence regarding your account and may use it to contact you directly when necessary. We also use your Personal Information to send you information and updates about upcoming campaigns from time to time.

Campaigns and Sweepstakes. If you participate in drawings, sweepstakes and similar contests in association with campaigns through our Site (“Sweepstakes”), whether by making a donation or using an alternate method of entry, we will collect, store, use, and disclose the information you provide (“Entry Information”) in accordance with this Privacy Policy unless stated otherwise, such as in the Official Rules for our Sweepstakes, or as stated in on the applicable campaign page. Entry Information includes your name, your e-mail address, your address and, where there is something to be sent to you, you shipping address. In addition, if you are making donations as part of a campaign, your payment card information will also be collected for payment processing purposes as described below. By entering Sweepstakes, you agree that we may share your Entry Information with tax-exempt foundation and/or charity benefitting from the campaign (“Beneficiary”) and the prize provider (the professional athletes, their teams and/or leagues, the “Prize Provider”) and brand sponsors for a campaign, if any, that such Beneficiary, Prize Provider, and/or Brand Sponsor may use your Entry Information for their own promotional, marketing and/or (for the Beneficiaries) solicitation purposes. Your information may be used to contact you for winner notification, prize delivery confirmation or other related purposes and, as discussed in our Official Rules, in order to enter Sweepstakes, you agree to grant us the right to disclose your name, photograph, likeness, voice, biographical information, Prize information, statements and address (city and state) to the general public if you are a sweepstakes winner. Your entry in Sweepstakes may also result in your being added to our mailing lists.

Payment Card Information. We use Shopify as our payment gateway to process debit card and credit card transactions. When you use a debit card or credit card to make a donation, you are actually providing your information to Shopify which collects and stores your debit card or credit card data. Shopify encrypts your payment card information to standards in compliance with the Payment Card Industry Data Security Standard (PCI-DSS). Your payment card transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your transaction information is deleted. PCI-DSS is a set of data security standards to help ensure the secure handling of payment card information. PCI-DSS is managed by the PCI Security Standards Council, a joint effort of credit card brands like Visa, MasterCard, American Express and Discover. Identifying Information. Unique identifiers (such as e-mail address(es)) are collected and may be used to respond directly to you when you request information or a response from us, as well as for verification purposes.

Information Requested Data. We track the kinds of information you request and view through our Site to help us determine what promotional and other informational mailings may be of interest to you. We will not send any promotional or other informational mailings to you unless you specifically request it or affirmatively indicate that you would generally be interested in receiving such information from us.

Internal Purposes. We use your Personal Information for our internal purposes. Those purposes include, but are not limited to, tracking the number and kinds of visitors to the web site, analyzing the performance of the web site, tracking customer preferences, and communicating to you about this web site. We may also use your Personal Information for internal marketing purposes as described more fully below.

Communications, Support Requests. If you contact us for assistance, to make a request or suggestion, or to report a problem or other issue through and/or regarding the Site, or any campaign, sweepstake or drawing running on the Site, we may collect and store your contact information, communication, and/or other information about you, including but not limited to your name, e-mail address, user name, location, and other information. We may use such information to respond to you, research your request/communication, and for other purposes in accordance with provisions of this Privacy Policy.

Social Media Widgets. Our Site includes social media features, such as the Facebook Like button, Pinterest, and Twitter widgets. These features may collect information about your IP address and which page you’re visiting on our site, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with those features are governed by the privacy policies of the companies that provide them.

Please note that information you may provide that is not specifically personally identifiable data, but rather information you may submit as part of a question or comment to us via the Site or any other information or data defined as "Posted Material" under the Terms and Conditions of Use for the Site is not covered hereunder as Personal information and is separately addressed separately under those Terms and Conditions of Use.

Traffic Data

In addition to “Personal Information” that you voluntarily provide, our Site also gathers data generated automatically by traffic to our Site (“Traffic Data”). For example, we use your computer’s IP address to help diagnose problems with our server, and to administer our Site. Your IP address is used to help identify you and to gather broad demographic information.

Our Site uses “cookies” to provide customer efficiencies such as automatically filling in standard information on return visits. "Cookies" are small pieces of information that are stored by your browser on your computer's hard drive. Most web browsers automatically accept cookies, but most browsers also allow you to configure your web browser to refuse cookies or to notify you before a cookie is set. This website uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses "cookies" to help the website analyze how users use and view the site. The information generated by the cookie about your use of the website (including your IP address, and particulars about your browser and configuration as reported by your browser) will be transmitted to and stored by Google on servers in the United States. Please note that information collected by Google Analytics cookies do not include personalized identification information (such as names, e-mail addresses, and payment information).  Google will use the information collected for the purpose of enabling us to evaluate your use of the website, certain aspects of your user experience on our website, compiling reports on website activity for us and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Security

We use commercially reasonable efforts to meet industry standards to safeguard the confidentiality of your personally identifiable information. Unfortunately, it is impossible to absolutely guarantee the security of data transmission over the Internet or any wireless network. Therefore, although we take such commercially reasonable measures to protect your information, we cannot ensure the security of any information you transmit to us or from online services and you do so at your own risk. Your credit card and debit card information is secured to PCI-DSS standards as described above.

Geographic Scope

Our Site, and the campaigns and sweepstakes run on the Site, are hosted in the United States and intended for the 50 United States and the District of Columbia. Each Sweepstakes drawing takes place within the United States and is limited to eligible entrants in the 50 United States and D.C. Accordingly, we make no representation that the Site, our Privacy Policy, or the operation of campaigns and/or sweepstakes run on the Site are appropriate or permitted in other locations, and access to them from territories where the Site, our Privacy Policy, or the operation of campaigns and/or sweepstakes run on the Site are illegal is prohibited. Those who choose to use and/or access the Site and/or participate in campaigns and/or sweepstakes from other locations do so on their own volition and are responsible for compliance with applicable local laws.

Choice/Opt-Out/Removal

Our Site provides you with a choice as to whether not you would like to receive communications from us at the point where we request Personal Information.

If you change your mind, you may withdraw your consent for us to contact your primarily by using the “Unsubscribe” link in any marketing or promoitional email that you receive from us.
